Terms of Service

These Terms of Service (“Terms”) govern your use of the Nieve mobile application and related services (“Service”), operated by a company registered in the United Kingdom. By downloading, installing, or using Nieve, you agree to these Terms. If you do not agree, do not use the Service.

1. Service Description

Nieve is a ski and snowboard tracking application that uses your device’s GPS and motion sensors to record and analyze ski sessions. The Service includes performance statistics, achievement tracking, resort completion tracking, cloud session backup, and social features.

Measurement Accuracy

All measurements provided by Nieve — including speed, distance, altitude, vertical descent, slope angle, airtime, G-forces, and turn counts — are estimates derived from GPS signals and device motion sensors. These measurements may be affected by environmental conditions, satellite signal quality, device hardware limitations, snow conditions, tree cover, mountain terrain, and other factors. They are not precise measurements and must not be relied upon for safety-critical decisions.

Not a Safety Device

Nieve is not a safety device. It does not monitor avalanche conditions, weather, visibility, piste closures, or slope hazards. Always follow resort rules, signage, and the instructions of ski patrol. Do not use the app in a way that distracts you while skiing.

2. Eligibility

You must be at least 13 years old to use Nieve and create an account, in accordance with UK law (Data Protection Act 2018). By creating an account, you confirm that you are 13 or older. If you are under 18, you represent that you have your parent or guardian’s permission to use the Service.

3. User Accounts

You can record ski sessions without an account, but cloud sync, social features, and achievements require one. You are responsible for maintaining the security of your account credentials. You must not share your account with others or create multiple accounts.

You can delete your account at any time from the app settings. Account deletion removes your personal data in accordance with our Privacy Policy. Deletion is processed within 30 days.

4. Use License

We grant you a limited, non-exclusive, non-transferable, revocable license to use Nieve for personal, non-commercial purposes. You may not:

5. User-Generated Content

You may upload content to Nieve, including avatar images, display names, and bio text. By uploading content, you grant us a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and adapt that content solely for the purpose of operating and providing the Service. This license terminates when you remove the content or delete your account.

You represent that you own or have the rights to upload your content and that it does not infringe third-party rights. The following content is prohibited:

We provide a reporting mechanism for flagging prohibited content and will act on valid reports with a statement of reasons for any content restrictions.

6. Intellectual Property

The Nieve app, including its design, code, branding, and content (excluding user-generated content), is owned by us and protected by applicable intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or branding.

7. Subscriptions & Payments

Nieve may offer premium features through auto-renewable subscriptions purchased via the Apple App Store. The following terms apply:

Right of Withdrawal

Under the UK Consumer Contracts Regulations 2013 (and the EU Consumer Rights Directive for EEA users), you have a 14-day right of withdrawal for digital subscriptions. When you purchase a subscription, you may request immediate access to premium features. By doing so, you acknowledge that you waive your 14-day withdrawal right once the digital content delivery has begun. This consent is requested separately from your acceptance of these Terms.

8. Inherent Sporting Risk

Skiing and snowboarding are inherently dangerous activities that carry a risk of serious injury or death. Risks include but are not limited to collisions, falls, changing weather and snow conditions, avalanches, equipment failure, and variations in terrain. By using Nieve, you acknowledge these inherent risks and confirm that you:

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under English law or applicable consumer protection law.

If you reside in the EEA or another jurisdiction where certain limitations or exclusions are not permitted, those specific limitations may not apply to you, but all other provisions remain in full effect.

10. Availability & Modifications

We strive to keep the Service available and reliable but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or due to factors beyond our control (network outages, third-party service disruptions).

We may modify, update, or discontinue features of the Service. We will provide reasonable notice of material changes through the app or by email.

11. Termination

You may stop using Nieve and delete your account at any time. We may suspend or terminate your access if you violate these Terms, with prior notice and a statement of reasons except where immediate action is necessary to prevent harm or comply with legal obligations. Upon termination, your license to use the Service ends. Sections that by their nature should survive (liability, intellectual property, governing law) remain in effect.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes at least 30 days in advance through the app or by email. Continued use of the Service after the effective date of changes constitutes acceptance of the updated Terms. If you do not agree with the changes, you may stop using the Service and delete your account.

13. Governing Law & Disputes

These Terms are governed by the laws of England and Wales. Any disputes arising from or in connection with these Terms shall be subject to the non-exclusive jurisdiction of the courts of England and Wales. This does not affect any mandatory consumer protection rights you may have under the laws of your country of residence.
